We're All in This Together

First, let me extend to you my well wishes and prayers for you and your loved ones. Be smart and be safe.

I wanted to also reach out to all of my current clients to reassure you that things are still moving forward. At a slower pace, but still forward.


The State Board of Workers’ Compensation (W/C) continues to operate:


Teleconferences – Judges adjudicating specific issues are doing so by teleconference with all of the parties.


Telemediations – Both private and State Board mediators are conducting settlement mediations over the phone or Skype or Zoom, which affords you the opportunity to participate. 


Telemedicine – Before the virus, insurance companies routinely sought to suspend the payment of weekly W/C benefits if a worker failed to attend a doctor appointment. Incredibly, many are still trying. I have twice now defended my client before a judge on this issue – both times I have won. Clients have very reasonable concerns about subjecting themselves to the virus while attending doctor appointments, physical therapy or an FCE. In fact, the State Board is now beginning to accept something called “telemedicine” as a substitute to physically attending medical appointments. Telemedicine is available with doctors who are willing to see patients by Skype, Zoom or even simply over the phone.


On another note, if you have a friend or family member who has been injured on the job, but who was later laid off because of the virus, they STILL HAVE A VALID W/C claim. Ask them to call me and I will fully explain their rights.


To all of my auto accident clients, the good news is that, even in normal times, I successfully settle 95% of cases without a trial. Therefore, the vast majority of your cases should not in any way be adversely affected by the virus.


Again, be smart. Be safe. The virus does not cause serious injury to most folks, but it can devastate others. Exercise smart social distancing and tell your family often that you love them.

Another tragic story of folks not having uninsured motorist coverage. Joe was traveling home from work and was involved in a terrible automobile accident. Joe has been hospitalized for over a month, and he will require months of physical therapy treatments both in the hospital and at home. Call the police immediately if the collision injured either you or the other driver. This is mandatory in the state of Georgia in all accidents resulting in injury or death, regardless of who appears to be the at fault driver. After law enforcement writes their report, ask the officer(s) on scene how you can obtain a copy for your own records in order to file an injury claim. The police report acts as the first piece of evidence gathered in your case. Reports typically take three to five days to process. Don’t forget this detail among all the other aspects of your accident claim.

Georgia’s workers’ compensation laws are intended to be “liberally construed” meaning that as a matter of public policy, benefits should be awarded to a claimant who suffers and injury while on the clock.
